Choosing the Right Will

Whether you choose to make your Will online, by phone or in person, Richard Nelson LLP is able to offer you a wide range of Wills specifically designed to meet your particular needs and able to be tailored to ensure that your precise wishes are reflected.
The following is just a selection of the types of Will which we can provide. All of our Wills allow you to:
- appoint people that you trust as your Executors who will step in and deal with your affairs when you die;
- deal with requests with regards to funeral arrangements (i.e. specifying whether you want cremation or burial);
- name specific individuals who can benefit from specific gifts e.g. your gold watch etc.;
- name specific individuals who can benefit from cash gifts;
- name your residuary beneficiary i.e. the person who will benefit from the remainder of your estate once all debts and administrative costs have been paid and specific and cash gifts have been settled;
- deal with the appointment of guardians should your children be under the age of eighteen at your time of death.
although you can, of course, incorporate any other terms which the law allows you to. More information can be found in the What Can I do in my Will factsheet.
If you choose to have us draft your Will for you then we will produce the Will that is most appropriate to your particular circumstances and we will tailor that Will to reflect your wishes and intentions. However, if you decide to use our online Will making service you will need to select the basic type of Will which most suits your purposes. That does not mean that the Will is not going to be fine-tuned to your needs - merely that the place from you start is not going to be the same.
There are three basic types of online will that we offer:
- a will for an unmarried person,
- a will for a married person, and
- a discretionary trust will.
In each case they are available as either single Wills or as a pair of wills for a couple wjho are living together - whether that be as husband and wife, civil partners or unmarried partners.
Wills for an unmarried person
If you are a single person, or someone who is divorced, widowed or in a relationship with someone to whom you are not married or not in a civil partnership, then this may be the most appropriate Will for you. It will be relevant whether or not you have any children (since it will allow you to make provision for any that you may have).

Wills for a Married Person
If you are married or in a civil partnership then there are a number of different issues to which you must give consideration and so the basic form of the Will is different from that for an unmarried person. As with the Will for an unmarried person, this is going to be relevant whether or not you have any children (since it will allow you to make provision for any that you may have).

Discretionary Trust Will
If you are married or in a civil partnership you may want to:
- to try and avoid a local authority using a share in the home to cover the cost of long term medical or nursing care for the surviving spouse/civil partner, or
- to ensure that gifts intended for children/grandchildren from a former relationship are received by them, without the danger of the surviving spouse/civil partner reducing the amount that goes to them.
If this is the case, then you may need to make a discretionary trust will, although you should note that to be able to do so, your marital home must be worth more than £50,000 after deduction of any mortgage, or your mortgage will be repaid on death by a policy of insurance.

Letter of Wishes
In addition to making a Will, you can also make what is known as a Letter of Wishes.
A letter of wishes is an informal letter addressed to your executors which expresses what you would like to happen following your death. Unlike your Will, the letter of wishes does not become a publicly available document on death. It can be used to assist or guide your executors on pretty much anything you wish. It does not interfere with or restrict the discretion of the executors in any way.
