Breach of Licensing Requirements

Trading Standards and Local Authorities continue to crack down on those who breach licenses for the sale of restricted goods. These include alcohol, fire arms, fireworks, cigarettes and other goods of this nature.

Those holding a licence for the sale of such goods often face scrutiny by local authority officers in order to establish whether they are complying with the terms of their licence. Enforcement officers will often carry out ‘test purchases’ to check the standards being maintained by licence holders.

Red Zones

Trading standards and local authorities are particular alerted to premises in “red zones”. These zones are identified due to particular concerns including the level of alcohol or drug abuse of the levels of theft from premises.

Premises in these zones are therefore susceptible to a high level of scrutiny by trading standards and local authorities and as a result often face a greater risk of being prosecuted for breaches of their licence.

Prosecution

Licence holders are often prosecuted of breaching their licence for many offences including selling restricted goods to underage persons or selling restricted goods without ever having a license to permit such a sale. Persons who face scrutiny by Trading Standards or a local authority may find themselves facing an interview by an enforcement officer. This interview may be conducted under PACE conditions and therefore legal advice is of greater significance as such interviews require certain formalities and procedures to be undertaken.

Punishment
